He was Northern Arts Literary Fellow at Durham and Newcastle (1985-7), and he now teaches Persian at Ohio State University. Borrowed Ware is published simultaneously with his new collection of original poetry, Touchwood.

About the Author

Frank Schmalleger, Ph.D., is Distinguished Professor Emeritus at the University of North Carolina at Pembroke. He chaired the university’s department of sociology, social work, and criminal justice for almost 20 years – while specializing in research in crime and delinquency. He has taught dozens of courses at both the graduate and undergraduate level in both on-ground and on-line environments.  Schmalleger is the author of many books and journal articles, including the standard-setting Criminal Justice Today, 14/e (Pearson); Criminal Justice: A Brief Introduction, 12/e (Pearson); Criminology Today, 8/e (Pearson); Criminology, 3/e (Pearson); Criminal Law Today, 6/e (Pearson); Corrections in the Twenty-First Century, 6/e (McGraw-Hill; with John Smykla); Courts and Criminal Justice in America (Pearson; with Larry Siegel and John Worrall); Juvenile Delinquency, 10/e (Pearson; with Clem Bartollas); and Policing, 2/e (Pearson; with John Worrall). Schmalleger has worked with U.S. military personnel -- primarily members of the Army’s CID, MP’s, Air Force SP’s and members of Air Force OSI from the late 1970s to the early 1990s helping officers make successful transition to civilian life. Schmalleger’s philosophy of both teaching and writing can be summed up in these words: “In order to communicate knowledge we must first catch, then hold, a person’s interest—be it student, colleague, or policymaker. An excellent guide

This is a fine history and guide to a legendary--and controversial--fortification system. Designed in the late 1920s and early 1930s, then built during the Depression (thus providing work, though at a massive overall cost), the largely underground border forts (ouvrage) faced both Germany and Italy. Behind their seeming impregnability the French military dozed, sadly convinced they merely had to occupy the gros (large) and petite (small) ouvrage to hold off any fascist invasion. Indeed, we speak of the "Maginot mentality" to this day to denote something providing false security.

All of this is discussed and assessed here, but the real appeal of this book is just how much detailed information is provided. I especially like the 3-D diagrams of the various Maginot ouvrage, as they offer a solid sense of each underground fort layout and its relationship to local terrain. I began with those ouvrage that I've seen in the south of France---and they bring back that visit of 15 years ago with their clarity. Furthermore, they make clear just how much variance there was in this massive construction project--all of it designed and built with nary a computer in sight.

The literature on Maginot's line is substantial---but much of it is quite understandably written in French. Works by Mary and Truttman, to name two of the best French authorities, are invaluable and offer excellent illustrations. But if you can't read the French captions and text, naturally much is lost. The Kaufmann's book provides a concise history as well as the all the context that anyone could need to visit the sites today (more of them are opening all the time). At the same time, it provides something of an English "key" to all those French volumes. I know that I will use both together from now on.

I strongly recommend this well-conceived and illustrated book. For the price, you will not find a better guide to and history of a fascinating fortification.

Excellent Introduction and Guide

This is an excellent introduction and guide to the Maginot Line. It concisely covers the purpose and history of the Maginot Line. It explains the technology and armament of the line. It is very well illustrated with maps, photos and drawings. There is an excellent section on what parts of the Maginot Line are open to the public today, and it includes contact and other information for the various sites.

Great read.

The book is an excellant modern study to the complete Maginot Line. Besides the main fortifications between France and Germany, it covers the minor fortifications between France and Beligum that were ultimately exploited by the Nazis and the fortifications between France and Italy, that were successful in stopping the Italion thrust into southern France. Also included are modern addresses and contacts for the fortifications that are open to the public.

About the Author
James S. Trieschmann, CPCU, CLU has a DBA degree from Indiana University. He was the Dudley L. Moore, Jr. Chairholder in Insurance and is a past president of the American Risk and Insurance Association. Dr. Trieschmann retired in July 2003 after teaching for 30 years at the University of Georgia.

Robert E. Hoyt (Ph.D. and M.A., Wharton School, University of Pennsylvania and B.S., University of Nebraska-Lincoln) is Professor of Risk Management and Insurance and has been a faculty member at UGA since 1988. He also studied as an ITT International Fellow for one year at the Universität zu Köln in Cologne, Germany. In 1995 he was the Fulbright Visiting Professor of Risk Management at the Vienna University of Economics and Business Administration (Wirtschaftsuniversität Wien). Prof. Hoyt teaches corporate risk management, risk theory, and insurer operations and serves as the Department Head for Insurance, Legal Studies, and Real Estate. In 1993 he received the Richard B. Russell Outstanding Undergraduate Teaching Award and in 1994 he was honored as the Terry College Distinguished Teacher. He was appointed to the UGA Teaching Academy in 2001.

David W. Sommer (Ph.D. and M.A., Wharton School, University of Pennsylvania, and B.B.A., St. Mary's University of San Antonio, Texas) is an Associate Professor of Risk Management and Insurance. He joined the UGA faculty in 1995. Dr. Sommer teaches in the areas of corporate risk management and employee benefits. His research interests include insurance company implications of ownership structure, and insurance regulation. Dr. Sommer's articles have appeared in various scholarly journals, including the Journal of Risk and Insurance, the Journal of Banking and Finance, the Journal of Insurance Issues, the Journal of Insurance Regulation, and the CPCU Journal. Dr. Sommer is the graduate coordinator for the RMIN area.

a good introduction or review

I used an earlier edition of this book as an undergraduate years ago and remembered liking it, so I bought a later edition for personal review. It has good coverage of principles of risk management as well as a review of the different types of insurance (for example, different types of life insurance (whole, term, etc.), with review of the benefits of each). Overall, for anyone who wants a review of risk management, an edition of this book is useful.

A former head of Cuban counterintelligence, he is internationally regarded as Cuba's foremost authority on US covert operations against Cuba and assassination plots against Fidel Castro. He also directed Cuba's investigation into the assassination of JFK.

Amusing

This book may not be well-written, but it is highly entertaining. What buffoons we have in our Government! Not only did the U.S. fail to kill Castro, but Castro found out about the plans.

Not included in the book: A sad part of our history which has been hidden from the public is that recently evaluated evidence demonstrates that Castro succeeded in killing John F. Kennedy. Unlike the bumbling U.S. operatives, however, Castro's operatives were better able to plan, execute and conceal their operation. This skill, combined with a U.S. media willing to protect Castro and his regime, has left the Kennedy assassination practically "unsolved." Of course, had the U.S. ever admitted Castro killed Kennedy, a U.S. response would have been necessary. Thus, to avoid escalating the Cold War and risking war with the Soviet Union, the matter was obfuscated and dropped by the U.S. Bottom line: Kennedy is dead, and his killer, Castro, is an old man. Amazing!

Strange narrative of a strange history

Fabian Escalante describes many plans and plots begun, hatched, aborted and terminated against Fidel Castro. Some plots involved persons affiliated with or hired by the American CIA, but many were begun by isolated groups and individuals. The man certainly made a lot of enemies both foreign and domestic, but apparently none of them managed to get a shot off at him or set off an explosion anywhere near him. Therefore it's not accurate to say that Fidel "survived" 634 assassination attempts.

The book contains some inaccuracies. On page 42, US Navy Admiral Arleigh Burke is described as "chief of the US Army." On page 22, the author refers to Batista as the "illiterate general," a strange label for one who as a young man "was a voracious reader with a driving desire to learn," served as an army stenographer who "would one day own one of the largest private libraries in all of Cuba." (Frank Argote-Freyere, Fulgencio Batista, 2006, page 20) Fulgencio Batista: Volume 1, From Revolutionary to Strongman

More puzzling is the author's narration that alternates between excerpts from documents or publications and his own literary reconstructions of meetings and plots. Yet more puzzling is how the author knows the details that he includes about furniture, body language (page 65: "Harvey swallowed"), winks, and drinks consumed over conversations. E.g., page 67 describes a meeting over "spaghetti a la Milanese" with "excellent rosé wine" but fails to name the Washington restaurant where it took place. All of this is presented with a too small number of references for his sources and neither a bibliography or index.

About the Author
Tom Bingham held office successively as Master of the Rolls, Lord Chief Justice of England and Wales, and Senior Law Lord of the United Kingdom, the only person ever to hold all three offices. He became a life peer, as Baron Bingham of Cornhill in the County of Powys, on becoming Lord Chief Justice in 1996. In 2005 he was appointed a Knight of the Garter, the first professional judge to be so honored. He retired in 2008, and in the same year was elected by the Institut de France as the first winner of the Prize for Law awarded by the Alexander S. Onassis Public Benefit Foundation.

A short book that everyone should read - particularly now.

In this timely and useful book Tom Bingham (Britain's former senior Law Lord) explains in Part 1 the sources of present British law from the Magna Carta onwards, and in Part 2 discusses the key parts of the present day British system also referencing U.S. law.

It's a short and handy book that I keep close by, to check on for example, the legal meaning of, "Equality Before the Law" or "A Fair Trial".

Part 3 is a first rate exposition of the Rule of Law and the Sovereignty of Parliament (parliament takes priority) and Terrorism and the Rule of Law (a "War on Terror" isn't a real war in the WW2 sense). It becomes more than clear that this particular "War" has seriously curtailed basic Human Rights with regard to torture, detention without trial, kidnapping and the right to privacy (phone tapping without judicial order).

I highly recommend this book (BTW Tom Bingham isn't a terrorist).

Fine study of what the rule of law means in practice

Tom Bingham, Lord Chief Justice 1996-2008, presents eight parts of the rule of law: The law must be accessible and so far as possible intelligible, clear and predictable. Questions of legal right and liability should ordinarily be resolved by application of the law and not the exercise of discretion. Laws should apply equally to all, unless objective differences justify differentiation. Ministers and public officers at all levels must exercise the powers conferred on them in good faith, fairly, for the purpose for which the powers were conferred, without exceeding the limits of such powers and not unreasonably. The law must afford adequate protection of fundamental human rights. Means must be provided for resolving, without prohibitive cost or inordinate delay, bona fide civil disputes which the parties themselves are unable to resolve. Adjudicative procedures provided by the state should be fair. The rule of law requires compliance by the state with its obligations in international law as in national law.

The European Convention on Human Rights (1950) was effected here by the Human Rights Act (1998). It says, "No one shall be subjected to torture or to inhuman or degrading treatment or punishment." (The US Bill of Rights bans the infliction of `cruel and unusual punishments'.) It bans slavery and forced labour - -even for benefits. It asserts the rights to life, liberty and security, to a fair trial, and to respect for privacy and family life. It upholds freedom of thought, conscience, religion, expression, assembly and association.

Article 1 of its Protocols protects: "Every natural or legal person is entitled to the peaceful enjoyment of his possessions. No one shall be deprived of his possessions except in the public interest and subject to the conditions provided for by law and by the general principles of international law. ... The preceding provisions shall not, however, in any way impair the right of the State to enforce such laws as it deems necessary to control the use of property in accordance with the general interest or to secure the payment of taxes or other contributions or penalties." Article 2 asserts the right to education.

Bingham argues that "The rule of law requires that the law afford adequate protection of fundamental human rights." A Constitution is not enough, nor is a merely rhetorical commitment to the rule of law.

He looks at terrorism's impact on the rule of law and urges that our responses be lawful, not a mimicry of the terrorists' actions. He warns, "it cannot be said that the UK has shown that implacable opposition to torture and its fruits which might have been expected of the state whose courts led the world in rejecting them both. In a sequel to the Belmarsh case ... the Government argued that evidence obtained by torture abroad without the complicity of the British authorities could be considered by the Special Immigration Appeals Commission, a contention which the House of Lords unanimously and strongly rejected."

Finally, he states, "The invasion of Iraq was `a serious violation of international law and of the rule of law'.

The foundations of a fair and just society

The Rule of Law says that "all persons and authorities within the state, whether public or private, should be bound by and entitled to the benefit of laws publicly made, taking effect (generally) in the future and publicly administered in the courts", according to Tom Bingham in this book. The book traces the history of the concepts contained in the Rule of Law from the Magna Carta through Habeas Corpus (the right to challenge unlawful detention), the abolition of torture, the Petition of Right, the US Constitution, the French Declaration of the Rights of Man, and the law of war, to the Universal Declaration of Human Rights.

The author then goes on to address specifically a number of principles included within the broad concept of the Rule of Law:

* The law must be accessible, clear and predictable
* Legal rights should be resolved by laws and not by discretion
* Laws should apply equally to all unless objective differences justify differentiation
* Public officers must exercise their powers fairly
* Fundamental human rights must be protected
* Effective civil dispute resolution procedures must be provided
* Trials should be fair
* The state must comply with its obligations under international law

Totalitarian regimes down through the ages have been characterised by flagrant disregard for the Rule of Law, for example by having arbitrary laws applied inconsistently at the discretion of the state, granting impunity to a corrupt ruling class, tolerating bribery, imprisoning and torturing people without trial, dispossessing people of property and rights at whim, and murdering prisoners of war who have surrendered. There is not much controversy over whether such practices should be prohibited; the controversy comes when governments enact exceptions to the Rule of Law, arguing special circumstances.

Controversial subjects which the author discusses include terrorism and the Rule of Law, the practice of "extraordinary rendition", discriminatory treatment of non-nationals, detention without trial, hearings in which the accused is not informed of the case against him, torture, surveillance, and the legality of the war in Iraq.

It seems to me that the duty of a state to comply with its obligations under international law is perhaps the most fragile of duties, because the source of those obligations is simply agreements between countries. If one country decides it no longer "agrees", there is very little that can be done to enforce the agreement. Thus the question of when one country has the right to interfere by force in the affairs of another will always be a very difficult one.
